The 2002 law is even called the born alive infant protection act. There is already plenty of punishment available for murderers.

Murder is murder and turning a blind eye is malpractice and murder. BUT like any other law the problem is enforcement. Unless you have watchdogs in every nook and cranny of your life there will be those who find ways of breaking them. Like gun sales and use, like immigration and drugs, like police brutality, like any kind of murder...
