The parents of two students at a private Christian school in Milwaukee, Wis., have sued government officials after a social worker allegedly body searched and interrogated the children without permission.

Seeking declaratory and injunctive relief as well as monetary damages, the American Family Association Center for Law & Policy and attorney Michael D. Dean filed the federal lawsuit on behalf of the parents Wednesday, citing multiple violations of constitutional rights, according to a statement from the lawyers.


The suit alleges social worker Dana Gresbach illegally entered the private school, Good Hope Christian Academy, by wrongly informing the principal that the law required she be allowed access to the children and ordering the principal not to contact the parents.

The attorneys point out, however, that in a recent federal lawsuit against the same government agency, the Bureau of Milwaukee Child Welfare, the Seventh Circuit Court of Appeals held that it is "patently unconstitutional" for government officials to seize a child on private school premises without a warrant or an emergency.

According to the suit, once inside the school Gresbach made one student, Ian W., raise his shirt, and the other, Alexis C., lift her jumper and pull down her tights so Gresbach could examine the children. When the parents learned about what happened, they were outraged and refused to meet with Gresbach, their attorneys said. Shortly thereafter, Gresbach closed the file.

Named as defendants are Gresbach, Denise Revels Robinson, the Director of the Bureau of Milwaukee Child Welfare, and Helene Nelson, secretary of the Wisconsin Department of Health and Family Services.

"The sheer arrogance of these social workers knows no bounds," said Stephen Crampton, chief counsel of the Center for Law & Policy, which represents the boy and his mother. "They have effectively thumbed their noses at the federal appeals court and laid claim to being a law unto themselves. We will not let them get away with this blatant violation of the law."

Dean, counsel for the girl and her parents, stated, "The untold damage done to God-fearing families like these by social workers who think they know better than parents may never be known. They must be held accountable."

Phone calls to Robinson and the state Department of Health and Family Services seeking comment were not returned by press time.
