Judge may decide if eavesdropping is legal

NEW YORK (Reuters)

The National Security Agency's domestic spying program faces its first legal challenge in a case that could decide if the White House is allowed to order eavesdropping without a court order.

Oral arguments are set for Monday at U.S. District Court in Detroit at which the American Civil Liberties Union will ask Judge Anna Diggs Taylor to declare the spying unconstitutional and order it halted.

The case goes to the heart of the larger national debate about whether President Bush has assumed too much power in his declared war on terrorism.


Bush said he authorized NSA intercepts soon after the September 11 attacks, allowing the NSA to monitor the international phone calls and e-mails of U.S. citizens without first obtaining warrants if in pursuit of al Qaeda suspects.

The ACLU sued the NSA on behalf of scholars, journalists and attorneys, claiming that warrantless wiretaps violate the U.S. Constitution and the Foreign Intelligence Surveillance Act of 1978, or FISA.

"The NSA has the capability of eavesdropping on anyone, anywhere, anytime," said James Bamford, an NSA expert and author who is supporting the ACLU suit.

Justice Department lawyers have asked the judge to dismiss the suit because it would reveal state secrets.

Regardless of how the judge rules on state secrets, the government lawyers say Congress granted Bush surveillance privileges by authorizing the use of force against al Qaeda following the September 11 attacks, and that he has the inherent right to order the wiretaps under presidential war powers. Eavesdropping..to save lives..kill or be killed..what a mess..

the only people who are against this..must have something to hide..I'd rather be safe then sorry..

And well, if we were all masters..which is what all should try to ahieve..then we'd know everything anyway..you see..

People with that attitude scare the hell out of me. You think that everyone who doesn't want the government reading their mail and tapping their phone-conversations has something to hide, Lotus? Do you really? Come on!

Bullseye. Maybe we should think about this a little bit before we start blithely giving up our Constitutional rights in the name of "National Security."

Not commenting on the whole issue due to time constraints but ... I just wanted to comment on this:

I understand what that sentiment is supposed to convey but one must always keep in mind that what you and I may consider "nothing to hide" may very well be what others are looking for to condemn us. You know, like being a "witch" or a "heretic" or a "pagan" or anything deemed not sufficiently "Christian" by the Church not too long ago. I certainly don't have any shame in regards to my beliefs in astrology, for example, but if I lived back then I would certainly be concerned about them becoming public knowledge seeing as how, you know, they'd kill me for them. Nowadays we respect (or are supposed to respect) privacy laws. Unless, it seems, we're chasing terrorists.
Frankly, does anyone have an explicit list as to what exactly the NSA is looking for in their spying to determine who fits their bill as a terrorist?
