Biden was a candidate (a private citizen and not the supposed President at the time) when he made a definitive statement and called Rittenhouse a white supremacist. The SCOTUS held that you can bring a civil case against the President for what he does before he was President.

I am not a legal eagle, but I think it would be sweet if Rittenhouse did sue Biden and won.

Biden made a reckless statement about a minor without any proof whatsoever to back it up. And he still has not retracted the statement.
