Nope, I would still go with the 7th ruler just like with any other guy I want to have a relationship with. His unavailable status would probably be very visible in the chart.

No he would still stay the 7th ruler, I'm talking about changing OUR sig? From Moon to Venus, since we're not the "main" person?

The querent is always the Asc ruler IMO. Look, horary chart is from the querent's POV. Querent wants a man, that is the main story; the fact that he is attached to someone else is the secondary story. I guess it would depend on how the question was phrased but I would use his 5th ruler (11th ruler) for her, Moon/Venus or a planet conjunct his ruler. Moon isn't always co-sig for the querent; I usually take it as "the flow of events", but it can be another woman for sure. I have seen it happen.
