RegardsThank you, I did have all my documents while out on leave, I followed policy to the letter, even playing with my own health and meds to get my blood pressure down enough to get back to work. I followed my doctors orders, returned only when cleared medically and was retaliated upon when I returned. Two others have taken FMLA since me and were not treated the same way I was. I did not take 2 month off by choice, I coughed a fracture into my back and couldnt move without pain for weeks, and all this is documented as well. Seems an employee in otherwise good standing should not be treated as such. And my needed job/skills has nothing to do with it. IP: Logged |

You're going to have to check your local (or state) laws in regards to wrongful termination.Pay particular attention to the wording "accepting resignation immediately" as that is legalize for "lol you're fired but we don't have to give you unemployment or deal with lawsuits". Whether or not you have a case is really depending on the local laws. Had you stayed, on the other hand, there were major red flags for possible impending law suits. Sadly, the best thing you could have done for them was put in that two week notice. My guess is, they were attempting the "stress until she quits" tactic in order to avoid insurance issues and possible other future issues related to your health. Look into filing a claim with EEOC (they deal w/employment laws) and they will let you know if you havea claim. If they made your job so unbearable that you had no choice but to leave that is called constructive dismissal.IP: Logged |
