On Friday morning, President Barack Obama defended his administration’s massive telephone records surveillance programs by explaining that “every member of Congress has been briefed on this program.”

There’s only one problem: both Republican and Democrat Congresspeople say that isn’t true. On Friday afternoon, the press office for Rep. Jim Sensenbrenner (R-WI), one of the authors of the Patriot Act, tweeted, “Obama’s claim that ‘every Member of Congress’ was briefed is FALSE.”

It wasn’t just Sensenbrenner. Sen. Jeff Merkley (D-OR) said that only certain members of the House and Senate Intelligence Committees had been told about the program, and he only knew about it because he received “special permission” to be briefed after hearing about it through the grapevine. “I knew about the program,” he said on MSNBC, “because I specifically sought it out. It’s not something that’s briefed outside the Intelligence Committee.” Merkley added that the administration had ignored the law. “Clearly the administration has not followed what an ordinary person would consider to be the standard of the law here,” he said.

Merkely summed up: “when the president says all members of Congress were briefed … well, I think a very small number of Senators in Congress had full details on these programs.”

Senator Dick Durbin (D-IL) said he only knew about the program after asking for a briefing under “classified circumstances.” The “average member,” he said, had no access to this information. “They don’t receive this kind of briefing.”

Senators Mike Lee (R-UT) and Jim Inhofe (R-OK) said they had not been briefed on the phone surveillance program, either. “Not quite!” Rep. Billy Long (R-LA) tweeted after hearing about Obama’s claim.

On Friday, Obama’s White House spokesman Josh Earnest said, “In December of 2009 and in February of 2011, the Department of Justice and the intelligence community provided a document to the House and Senate Intelligence Committees to be made available to all members of the House and Senate, describing the classified uses of Section 215 in detail.”

Senators should have known about snooping, says McCain

(CNN) – Lawmakers who are now expressing outrage over the government’s surveillance of phone records and Internet activity should have paid closer attention when they were voting to reauthorize provisions in the Patriot Act, Sen. John McCain, R-Arizona, said Sunday.

Reacting particularly to fellow Republican Sen. Rand Paul’s assertion this week the programs amount to an “assault on the Constitution,” McCain told CNN chief political correspondent Candy Crowley that members of Congress had not been left in the dark on what powers the government has in monitoring Americans.

“The Republican and Democrat chairs, and ... members of the Intelligence Committee have been very well briefed on these programs,” McCain said. “We passed the Patriot Act. We passed specific provisions of the act that allowed for this program to take place, to be enacted in operation. Now, if members of Congress did not know what they were voting on, then I think that that's their responsibility a lot more than it is the government's.”

Paul, a Kentucky Republican who enjoys support from a large bloc of libertarians, was elected to the Senate in 2010, years after the Patriot Act was first passed. However, the key provisions of the act that have been subject to scrutiny this week were reauthorized in the past two years.

In 2011, when Congress was debating the re-authorization of Section 215, Paul offered amendments that would have limited the government’s powers of surveillance.

Section 215 allows the FBI to apply to the Foreign Intelligence Surveillance Act court - FISA court - to issue orders granting the government access to any tangible items in foreign intelligence, international terrorism and clandestine intelligence cases. It’s the measure cited this week in a leaked document that revealed the Obama administration obtained a secret court order for phone records from Verizon.

Some lawmakers from both parties say they’re worried the government’s interpretation of the law – and not the law itself – is being kept secret from members of Congress. McCain argued Sunday for continuing the practice of only briefing intelligence committee members on top secret actions taken by U.S. agencies.

“I don't think the 535 members of Congress should be briefed on every program that our government is engaged in. That's why we have intelligence committees,” McCain said, adding he would be open to involving the rest of Congress on some additional discussions of intelligence gathering.

I am glad to see you guys coming out against Bush now. It's a bit late, but at some point everyone must learn, huh?

It's a fair point to call Obama George Bush III, but it's interesting that there wasn't Republican backlash against Bush. I mean, it's kind of insane, the situation here. Bush's administration acted over-aggressively, and got Republicans into warmongering fervor. Then, when it's essentially a Democrat's turn for office, the implication is that any Democrat is going to have to be as vigilant as a Republican in order to win. What happens? Obama endorses virtually all of Bush's programs, while getting in trouble with Conservatives over promises to be more diplomatic. Now, suddenly, we see that Bush programs weren't and aren't actually embraced by Republicans. That was merely standing in solidarity with the party leader. Now you reap what you've sown Republicans.
