I wonder how many challenges come up against the Income Tax every year. The Civil Rights Act. Rowe vs Wade...as the article says, tons of challenges to lots of laws...they are still the law until struck down in their entirety. Some parts of some of them have been chipped away.Jwhop says 2-3 elections and all the nasty liberal encroachments of the last 50 years will be gone. Who was in the White House/Congress over those 50 years? Johnson, Nixon, Ford, BUsh, Bush, Reagan, Clinton and Carter. Seriously corrupt bunch of libs right? And lets not forget Eisenhower.. I guess some people really believe that slaves were happier and healthier than free men, that black people spoil the dining experience of white folk, that women shouldn't control their own bodies or make decisions for themselves...how bout taking away their vote? After all, it took 150 years for us to bang that one through! Heresy... This is not about liberals and conservatives. Most Americans are straddling that divide and want to continue to do so. Exactly Randall."The Internal Revenue Service has ruled that this tax credit will be available to lower income people in every exchange across the country. But the new lawsuits contend that the IRS has simply misapplied the law. The law, as they read its wording, says that the tax credit only applies to those shopping at an exchange run by a state government, not at the federal substitutes."...which is what O'BomberCare actually says. I wouldn't foresee that particular issue being a significant one, Jwhop.Equal treatment under the law is a viable interpretation by the IRS. It shouldn't matter if one uses the State exchange or the Federal exchange made necessary by the lack of state cooperation. IP: Logged |

Origination argument:
One of the arguments for dismissal propounded by the Department of Justice is that, “the court’s review under the Origination Clause is quite limited, as the clause imposes only minimal requirements. It may be for that reason that the Supreme Court has reviewed only eight Origination Clause claims in its history, and that it is has never invalidated an Act of Congress on that basis.” http://www.forbes.com/sites/theapothecary/2013/09/13/will-the-courts-derail-obamacare/

Well, even the IRS hates Obamacare, so we will see how that affects enforcement of the mandate. IP: Logged |
