We don't know yet whether they were unlawful as the Supreme Court has not weighed in. Republicans weren't conducting business at the time of appointments in question. They were, in fact, deliberately (being douches) staying in session merely as a way of blocking such action from the President.However, it is still worth noting that within a practice as seemingly controversial (and yet pervasive) as recess appointments, he's made the fewest by far.
