December 14, 2018 A federal judge in Texas threw a dagger on Friday into the Affordable Care Act, ruling that the entire health-care law is unconstitutional because of a recent change in federal tax law. The opinion by U.S. District Judge Reed O’Connor overturns all of the sprawling law nationwide. The ruling came on the eve of the deadline for Americans to sign up for coverage in the federal insurance exchange created under the law...........

Even when Pesident Trump isn't trying to win, he wins! Winning by osmosis! So, since Roberts ruled the mandate was a tax, and the tax is gone, it is now unconstitutional. I predict a 5-4 SCOTUS ruling. Na na na na, na na na na, hey hey hey, good bye!IP: Logged |

Roberts had to twist himself into a pretzel to find what was clearly a fine/penalty for not buying Obamacare...to be a tax.Now, Roberts is hung up due to the fact Congress removed the compulsory Individual Mandate to buy Obamacare insurance. IP: Logged |

You don't have to buy a car to insure. Living and breathing in America made people subject to buying something they didn't want, or couldn't afford...or pay a fine for not buying Obamacare. First time in American history that people had to buy a product just because they existed. We point to the sky, and Cat looks at the ground. Obamacare was narrowly saved by Roberts who proclaimed the mandate to be an excise tax and thus constitutional. It was sheer genius of the Trump team to include the mandate in tax reform, although, no one could have predicted just how ingenious it was. IP: Logged |

In much of America a car is a necessity. Quibble if you like but you know it will be appealed and Roberts is going nowhere in the foreseeable future. As expected, he also stayed enforcement of his ruling to allow time for a challenge in the Fifth Circuit Court of Appeals by a group of Democrat-controlled states led by California Attorney General Xavier Becerra. Most “news” reports focused exclusively on the stay, which comprises one page of the document, while ignoring twenty-nine pages that Judge O’Connor devotes to a detailed elucidation of his previous ruling.
