Cruz has appeared before SCOTUS 9 times before. This would be the 10th. He said today: "Petitioners' legal team has asked me whether I would be willing to argue the case before the Supreme Court, if the Court grants certiorari. I have agreed, and told them that, I will stand ready to present the oral argument."

I think it was because SCOTUS wants to take the case against four states instead. The Court asked the four states to respond by Thursday.
