What are his odds? While he can continue his tariffs even if SCOTUS rules against him (just switch to a different law), I would say his chances are reasonably good. Let's look at the ruling against him. It's not like it was unanimous. It was 7 to 4. The dissent gave a very compelling roadmap that SCOTUS will refer to. They did all the work for SCOTUS. And one of them was the most liberal judge in that court! The reason this is a good thing is because SCOTUS will likely define the parameters of Presidential power to include tariffs. IP: Logged |
