He was absolutely correct. President Trump is the Executive branch. Thus, the President has absolute authority under all things governed by the Executive. Or in the case of the issue at hand, Commander-in-Chief plenary power. The President solely exercises control over the armed forces. Title 10 (which governs the armed forces) includes within that plenary authority the federalizing of the National Guard in cases of insurrection or invasion (even though it doesn't specifically mention the word "plenary"). No, he didn't. He accurately described the law. I explained it to you, and you still don't get it. All Miller did was explain Title 10 and how it dictates a President's plenary authority to federalize the National Guard. Congress (legislative branch — makes laws and controls spending) Courts (judicial branch — interprets laws and can strike down executive actions) The Constitution (which defines, separates, and restricts powers) IP: Logged |
