Apparently so. Most SPAM will be legal if it includes an unsubscribe link and if it doesn't violate a few rules. Violation of those rules, however, will result in prison time.

Yup, I don`t see how they could claim it was illegal in the first darn place!!!

The 'unsubscribe' is a big joke. Currently the unsubscribe links simply confirms your active address and they double the spam .
