I believe I was detained in unnecessarily cruel conditions as a result of being discriminated against because of my physical disabilities.

Thursday, I turned myself in because I had two old minor traffic violation tickets. I decided to take care of it and scheduled an appointment to turn myself in because I could not afford to pay for them.

I talked to an officer about what I needed to do and what I could bring. I explained that I was disabled and lived on a very small income, therefor I would have to sit the tickets out. I explained to him my concerns about my physical limitations and whether or not I would be able to handle it. I was assured that it would not be bad and that. He failed to tell me about quite a few things.

I was not informed ahead of time that I would not be allowed any medication. I missed three doses. On top of that, some of the medication they confiscated were supposed to be refrigerated. My sister had the foresight to call and check. It had been left out for nine hours. Ruined.

When we arrived at the jail they placed me in the Female Detox holding cell because it was the only one empty. I had to be in a cell alone because I need a cane to walk and they said it could be considered a weapon. Since the bench was just a few inches off the floor, I could not get on it. So they brought me a hard plastic chair.

The nature of my disability is severe rheumatoid arthritis. The worst joints affected are the hips and knees. I also have flexion contractures on my knees so my knees are permanently bent and it makes walking and standing extremely difficult. And it makes kneeling or crawling physically impossible.

They placed me in the cell and left me. I was placed in at about 3:30 p.m.

After about an hour of sitting in one place I started having severe pain in my hips. I tried adjusting my positions. I did not want to be a nuisance so I held off my complaints until about 7:30. I had noticed that all of the woman who came in about the same time as me had already been processed and taken to a cell hours before.

I pushed the buzzer and an officer came to the door and asked me what my problem was. I told him I couldn’t sit in a hard chair for this long, especially since I was not able to have my medication, which included pain pills and steroids to help the inflammation. The officer told me it was too bad that I had it better than the other inmates because I had a real chair.

I asked him when I was going to be taken to a cell where I could recline and stretch my hips, and he told me that they didn’t have any room for me because I had to be placed alone.

I asked if I could see the paramedic then so she could explian to them the nature of my pain. He shrugged his shoulders and walked off.

Half an hour later I buzzed again, and he came up to the window and yelled at me for pushing it. I asked him if I could just call my family so they could come get me. I told him I hadn’t realized how much pain I would have to be in.

I never asked for special treatment. I want that understood. I only wanted to be processed like all of the other inmates. But since I was handicapped they did not take me out of the detaining cell.

I had to sit in the chair for a total of eighteen hours in severe pain. I tried holding myself up off my hips using my arms. At one point I let myself fall to the concrete floor so I could at least stretch my joints. A couple hours later I pushed the call button because I couldn’t get up off the floor. The woman who answered the box sighed angrily and cussed at me. They helped me back in the chair and told me not to get in the floor anymore. I told them I had been sitting in the chair for fifteen hours and was in alot of pain.

Throughout the afternoon, night and morning I asked for a doctor four times and was denied. I was denied all medication(including the non-narcotics).

I asked to see the judge in the morning and they would not allow me to do that either. My sister was able to post bail and I was allowed to get out of the chair at 9:30 the next morning.

I was never processed like every other female to come through the jail. I know it was because I was disabled. If I wasn’t I would have been processed like everyone else and allowed to sit without pain. No matter how I tried to explain to the two officers about how much I was suffering, all I was met with was sneers and disdainful comments.

I just think that it was an excessive punishment for an expired car tag. I think it was excessive to place a person with a disease that attacks joints in a hard chair for eighteen hours with no medication. I was also told that if no one came to bail me out I would have had to stay in that same cell, in the same chair, until Saturday morning.

I forfeited the eighteen hours I spent in jail because I cant even imagine how bad I would feel then. I’m already in so much pain right now that I cant even sit.

If they didn’t have room for me, they should have released me. I turned myself in.

So to sum up:

-I was denied the right to see the judge when he came in.

-I was denied the right to see a paramedic

-I was not told my medication would be confiscated

-Because I was disabled, I was not allowed to be processed like everyone else. Because I was disabled I had to stay in extremely painful conditions, while I watched person after person be processed.

Apparently, this is how people with disabilities are treated. Not as equals, but as inconveniences, that are too bothersome to be dealt with.

I have filed a complaint with the Texas Commission of Jail Standards,

The Federal Department of Justice,

and my congressman,

I know nothing will come of it though. These things never do

zen, what a horrid experience -- my heart goes out to you
You did the right thing to file a complaint, even if nothing ever comes of it. It was a good idea to write to your State Representative and/or Senator -- this was unconscionable treatment and a clear violation of the ADA.

That's terrible - what you had to endure. Where was their ability to discern and be compassionate. These people have become hardened to their job.

You were trying to do the right thing. I guess we can learn that walking into a police station by oneself, leaves one vulnerable.

My faith in people has diminished lately. I'm sorry to read of your experience. Thatnk goodness for LL where you have friends.

That breaks my heart for you, Zen...

I think it is so awful that people are treated this way. You are already in constant pain, and to make you endure more of it is just unbelievable.

I hope you get some justice for this, or at least by filing compaints, can draw some attention to it at that police department.

Those people don't have even a molecule of compassion in their bodies.

Zen, may I also suggest that you write to your newspapers or whatever public service media available to draw attention to what you've been thru? That is, if it's alright with you to make your experience public (in the hope that the concerned authorities will address the issue faster).

wow Zen! Unbelievable...

I spent a weekend in jail once...years ago.
And I remember the experience vividly. They treat you like cattle. They yell and curse at the inmates. I remember the next morning I didn't want to eat or drink anything. The cop came to the cell and yelled at me to come get my f'ing cup filled. I was so scared.. I remember shaking as she filled it.

I understand that the experience isn't supposed to be compared to your local Marriot, but there should be limits.

Especially where you are disabled. They should have protocol for that. Good for you for filing complaints! I hope someone is left to awnser for the way you were treated. That is uncalled for!

Keep us posted if you hear anything back, okay? I'd keep on pushing until someone responds. They at least owe you that!

I agree with CC-keep pushing until you get a response.

Also, write to the newspapers telling of your accounts, the more people know, the more it might be exposed and be stopped.
Also, post your experience on the Net where there will be much more exposure. This should not go on...

Thanks for the responses everyone.

I thought about contacting the paper. And posting more online. It's just hard putting yourself out there.
I've read alot of posts from people who responded to complaints.
Theyre always along the lines of
"well you broke the law. deal with it"
" Or, well stop breaking the law. It's MY tax dollars going to the jails. "

The whole time I was in there, I kept thinking, if I wasn't poor I wouldn't be in this situation. If I had money I wouldnt be treated like scum. If I wasn't sick, I wouldn't be broke. If I hadn't gotten sick I would have had the money to pay for my tags.

I know theres no excuse for what went on.

But the situation in my life when I got my ticket was a really hard. It happened at the same time I had lost my apartment. I had lost both my jobs. My savings were wiped out because I did not have insurance when I was diagnosed. And I could not get help paying for doctors, medications, tests, etc.

My car was scheduled to be reposessed. I was driving without tags because I was ONE class away from graduationing with my associates. I HAD to finish.

But nobody cares about extenuating circumstances.

Some people just respond with such anger. And I lost even more faith in people this weekend.

I just cant comprehend treating another individual so harshly. I just dont understand whats wrong with this world. And sometimes I just get disgusted.

But yes, thank God for places like Lindaland.


Oh and the worst part is that I still owe the full sum for the tickets, plus $300 for bail and a warrant is still active.

Yeah, but in NO way did you deserve to be treated like that. I've heard of people doing much worse and getting their health and dental taken care of while incarcerated... free! Well okay, paid for by the tax payers.
All you required of them was to make sure you got your meds. To see a paramedic would have probably enforced that you needed more then a plastic chair.
Again, there should be protocol when dealing with handicapped people. That is so upsetting!! uurrgggg!
I hope you get some sort of apology...at least! And be sure to mention the $300 in your complaint. The LEAST they can do is waive that.
I'm so sorry that happened to you.. I'm diabetic and I know if I was denied my meds I'd be furious!

I left another complaint through the County website.

Im so full of indignation I could burst.

Makes me want to picket. And scream. And make sure this never happens to anyone again.
Makes me want to change things.
Makes me want to push for reform.

Bleh.

I wrote to my senator this morning. Then the Mayor, and the Governor.

I just keep getting angrier and angrier.

Which is not like me at all.

I've called the jail and they wont give me the name of the officer. They said I would have to go back to the jail to get the complaint form.

No way in hell am I ever going back there.

I'm so sorry to hear about this horrible experience. Can you send someone back to the jail on your behalf to get the form? And anyway, why should a physically disabled person have to go in? This is also wrong. You should be able to get the form in the post. It is discrimination - you should be able to get this information without moving a muscle.

Sometimes it is right to be angry. You're an Aquarian and this is a human rights violation. I'm not at all surprised you are furious.

They have a Public Defender Service in the UK where you can get free legal advice if you have an issue with the justice system etc. I don't know what Texas has to offer - anybody in the US able to comment?

I'm really sorry to hear about this zenwarner. You're in my thoughts.

maybe email someone at your local newspaper and tell them exactly what youve told us here? doesnt hurt to try...the more media exposure, the more theyre likely to listen.
