I would love to see who the "sh*t for brains" is behind this raid. The purpose of this is to scare the public by releasing fake news until the mid-terms. President Trump, as the Commander-in-Chief, had the absolute, unrestricted, Constitutional authority to declassify any record he wanted. This was confirmed by the SCOTUS in 1988 in Department of the Navy v. Egan and in a few other cases. President Trump also had the sole statutory authority to determine whether these records were personal records that belonged to him or were records that go to the archives and then back to his library, as confirmed by an Obama-appointed judge in 2012. The magistrate judge was biased and espoused his hatred for President Trump all over Facebook; therefore this mental midget violated Canon II of the Code of Judicial Conduct, so he not only shouldn't have signed anything, but his recusal is required. These records belong to President Trump. He was negotiating with the archive bureaucrats to determine what to send them, and no one had a problem with the way he stored the records, other than requesting that President Trump place an additional lock on the door. President Trump's legal team should file a 41(g) Motion under the Federal Rules of Criminal Procedure to return the property, and then President Trump's legal team can take control and go ahead and fight this battle now."When the property is seized but the government does not file criminal charges against a claimant, the Rule 41 (g) motion filed by the claimant is treated as a petition to the district court to exercise its civil equitable jurisdiction. This is a slam dunk. General search warrants are a violation of the 4th Amendment. A warrant must specify with particularity and specificity what is to be seized and where it is to be located.Fake news claims that there is a written procedure to declassify documents. Wrong. The President IS the Executive Branch. But in October of 2020, there was a sweeping declassification. President Trump announced it on social media. And in December and January before leaving office, he declassified entire sets of documents. The burden of proof is on the government to show President Trump did NOT declassify these documents. President Trump does not have to prove anything. His mere possession of them (if acquired during his Presidency) are prima facie evidence of that fact. Any other interpretation is a legal fiction. The Espionage Act simply cannot apply to a POTUS. Now they are saying "protocols and procedures" were violated. When you go to that argument, you have lost the factual argument. IP: Logged |

I don't recall ever saying I'm afraid of the FBI....or the Justice Dept. The Department of Justice was created by an act of Congress. The FBI was cobbled together from Secret Service agents and they can be defunded and disbanded by Congress at any time. Something the willfully unlawful agency heads should keep top of the mind.
