WASHINGTON (CN) — A Maryland man deported to an infamous prison in El Salvador must be returned to the U.S., the Supreme Court ruled Thursday, upholding a federal judge’s order forcing the Trump administration to facilitate his return.

Kilmar Abrego Garcia was swept up in deportation flights last month and sent to a terrorism center in El Salvador despite a judge's order finding local gangs would persecute him in his home country.

The Trump administration conceded that Abrego Garcia was sent to El Salvador’s Centro de Confinamiento del Terrorismo, or CECOT, by accident but fought an order to return him to the U.S. A Maryland judge ordered Abrego Garcia returned by midnight on Monday. The Justice Department said the request was impossible and asked the Supreme Court to intervene.

“The Government of El Salvador has custody of Abrego Garcia, so he cannot be returned to the United States unless the Government of El Salvador releases him,” U.S. Solicitor General John Sauer wrote. “Compliance with the district court’s order thus requires the Government of El Salvador to ‘release Plaintiff Abrego Garcia from its prison.’”

Under a deal with El Salvador’s president, the Trump administration is paying the country $6 million to hold U.S. deportees. Secretary of Homeland Security Kristi Noem toured the prison last month, calling CECOT one of the tools in the U.S.’s toolkit.

Abrego Garcia’s attorneys said the statement is proof that the Trump administration can facilitate migrant returns.

“The U.S. Government functionally controls Abrego Garcia’s detention — it has simply contracted with El Salvador to be the jailer,” Abrego Garcia’s attorneys wrote.

Chief Justice John Roberts, a George W. Bush appointee, issued an administrative stay Monday, pausing Abrego Garcia’s return order until the high court reviewed Trump’s emergency appeal.

Abrego Garcia was working as a sheet metal apprentice in Maryland, where he lived with his wife, a U.S. citizen, and their three children before his arrest. The Department of Homeland Security gave him a permit to legally work in the U.S., according to his attorneys.

A U.S. immigration judge released Abrego Garcia after shielding him from deportation to El Salvador in 2019. Immigrant and Customs Enforcement did not try to capture him until Secretary of State Marco Rubio declared MS-13 a foreign terrorist organization. The Trump administration claims Abrego Garcia is a member of the gang — a charge his lawyers strongly contest.

No, he merely cannot be deported to El Salvador due to the original judge's temporary order in 2019. Do you even know why that order was issued? Because being in MS-13, he was scared of a rival gang. He will still be deported. He just can’t be deported to that country. So, don’t be so celebratory.

He wasn’t illegally deported. He was deported to El Salvador (his home country) when he had a temporary order from a judge in 2019 not to be deported there for fear that a rival gang would harm him. He is also a human trafficker.

The Supreme Court said to "facilitate" his return, i.e., provide a plane. SCOTUS didn't say "effectuate" his return. Big difference. The El Salvadoran government has jurisdiction over its citizen.

He’s not a “Maryland father.” He’s a MS-13 gang member human trafficker.

Everyone forgets the rest of what the Supreme Court said. They said that these district court judges cannot overrule a President in making these types of Executive decisions. End of story for those clowns in robes.

I’ve just looked up the chart for the United States, and where the house is for Aries. It’s the fourth house… so, does Neptune in Aries represent the kidnapping and human trafficking of migrants, people with green cards or visas, those married to citizens, and now also citizens themselves?

No, he's not ignoring the SCOTUS order. He was told to FACILITATE the return, not EFFECTUATE it. Legal semantics matter.

I hope he isn’t dead. They refused to let a senator see him, and when asked if they could arrange it next week (the “with more time” the VP alluded to), they still said no.

He asked for a phone call, and they said maybe the embassy could arrange it.

The trump admin is paying them $6 million a year, to hold prisoners. That’s government waste, in my opinion. Where is Elon, to end this?

Do you mean the Senator who ignored the rape and brutal murder of one of his constituents, Patty Morin, by an illegal immigrant who was just convicted? Morin had the back of her skull crushed, was dragged, held up against a wall and raped as the blood poured around her body and then thrown to the ground and raped again. Then he choked her to death, literally crushing her throat. And that Senator had no comment because it was by an immigrant. He only cares about the Maryland man because he thinks it hurts President Trump. The Maryland man has a rap sheet a mile long. His wife even got an injunction for safety and a restraining order in 2021 saying that he beat her twice. No comment about the rape and murder? No comment about the wife beatings? Is it more crickets from the left? Are the ones always shouting about protecting women the same ones ignoring true violence against women by ilegal immigrants?

In October 2019 he was granted a "withholding of removal" order, court documents show - a status different from asylum, but one which prevented the US government from sending him back to El Salvador because he could face harm.

Mr Abrego Garcia's lawyers say that he was granted the status based on his "well-founded" fear of persecution by Barrio-18, the main rival gang of MS-13.

TRANSLATION:
Abrego was found by the court to be a MS13 gang member, but was granted "withholding of removal" (which is NOT asylum) because his attorney argued that as MS13 member, if he was returned to El Salvador, he could face reprisal from Barrio 18 gang, a gang rival of MS13.

on the allegations of Spousal Abuse

Recently unveiled documents showed the reasons why in 2021, his wife, Jennifer Vasquez Sura, filed a protective order petition against him, alleging that he had physically attacked her on multiple occasions, according to documents shared by the US Department of Homeland Security.

He's alive, but the visit was staged by that prat who runs El Salvador.

I also saw doctored photos of his hands, by the trump admin. Because of course, you guys could elect a criminal, and he got away with everything (so far), but this guy wasn't allowed any due process at all, and now they're making things up about him. It's foul.

About that audio...

Dude was definitely a domestic violence perp. in 2020, according to the wife's testimony, the neighbor witnessed the abuse, and also her sister. Nobody makes up lies and names eye-witnesses. She also explained that she was going to report his continuous abuse earlier, but HIS family talked her out of it!

That she was still with him in 2025 shows that she feels trapped.

My conspiracy theorist mind thinks it was the wife who probably reported him to ICE so she would be rid of him. But then the woke left took over his case and made it a national case and she is forced to toe the line and do what they want and beg for his return, while probably praying silently that he stays in El Salvador.
